This book provides a comprehensive and detailed analysis of criminal law in NSW and human rights protections – both domestic and global. The book details each of the following aspects of criminal law: classifying crimes, the processes of investigating crime, the operation of the criminal law in respect of the gathering of evidence, trial and sentencing processes, young offenders and international crime and criminal law processes. Human rights is discussed with reference to the articulation and development of human rights in formal legal documents. The subtlety of first, second and third generation rights is explored as are limitations in human rights protections arising from issues of State sovereignty.
